Sir,  Sub: DPC for promotion against vacancies available in the grade of Superintendents of Central Excise and Customs -  reg                      It is learnt that DPC for promotion from Inspector cadre to Superintendent cadre is not being held on account of referring the CAT, Ahmedabad’s decision (OA No 405/2014) to Board. In this regard, it is submitted that efforts may be made to get reply/directions from the Board. Still, even in case of non-receipt of any reply/directions from the Board, the said DPC may be held looking to the following facts- 1.  The CAT, Ahmedabad’s decision (OA No 405/2014) is nothing but directions to follow Hon’ble Apex Court’s judgement in case of N R Parmar and the Board has already taken a stand to follow N R Parmar’s judgement in terms of OM No A-32022/06/2014-Ad.IIIA dtd 8th September,2014. Hence the referring the CAT, Ahmedabad’s decision (OA No 405/2014) to Board has no significance except academic one . 2.  Several other zones have held DPC & issued promotion orders from the cadre of Inspector to Cadre of Superintendent even after delivering of CAT, Ahmedabad’s decision (OA No 405/2014). Copy of one such latest order issued by Delhi Zone  is enclosed for ready reference. 3.  Otherwise also, three months provided under the said CAT, Ahmedabad’s decision for revising seniority list is already over  & the issue is already settled vide Board’s OM No A-32022/06/2014-Ad.IIIA dtd 8th September,2014, DPC can very well be held now without waiting any directions from the Board. 4.   Without prejudice to the above, it is submitted that even if the CAT, Ahmedabad’s decision (OA No 405/2014) is taken into cognizance & Board’s directions are not received,  the DPC for opening of sealed cover may be conducted without waiting for any directions from the Board. Therefore as a first step towards justice to very senior Inspectors, DPC for opening of  sealed covers may be held.                  In view of the above submissions, without prejudice to our submissions made vide our letter of even number dated 06.04.2016, it is requested in the interest of justice that DPC for promotion from the cadre of Inspector to Cadre of Superintendent may be held on top priority basis, preferably in this month itself.                                                                      Yours faithfully,                                                                            (M.S. Sir, Subject : Review of Transfer/Posting/Rotation for Group-B Executive Officers of Vadodara Zone – regarding.             Kindly refer to your office letter No. II/03-22/CCO/2015 dated 05.04.2016 on the captioned matter. 2.         In this connection, All India Central Excise Inspector’s Association, Surat would like to submit the following comments/points for your kind consideration for review purpose of the aforesaid policy and incorporation/amendment accordingly : (i) In the said policy, there is a provision of normal tenure of a cluster for nine years and three years in a Commissionerate. It is however submitted that the due list issued by the department mentions names of only such officers who have completed nine years in a Cluster. Names of the officers, who have completed 3 years in a Commissionerate and are due for Commissionerate change may also be published. Nine years term for cluster change and three years term for Commissionerate change must be complied without exception. (ii) Para 5.3 providing for continuous 2 years non-sensitive charge in respect of on request transfer should be implemented strictly without any exemption or relaxation. (iii) As per Para 7.1, the officers who have completed 6 years in other 2 Commissionerates of the Cluster, may be considered for posting to Audit Commissionerate. (iv) Postings to Customs zone should be made only through the available pool of the officers as per existing provisions of the policy and no direct recruit be posted in Customs at his first posting. Only seniority wise posting to Customs may be adhered to since there are many officers who are left untouched being neither the senior-most nor the junior-most during the relevant time for several years. (v) There is no tracking of the officers who have exceeded their maximum tenure in DRI, Surat such as Sh. Bharat Kumar Patel, Inspector (S.List No. 641) was deputed to DRI Surat on 06.05.2010 for five years and has exceeded his tenure by around one year, whereas application for deputation to DRI Surat of Sh. M.S. Prabhat, Inspector is pending for more than one and half years. It is requested that officers may be repatriated from deputation immediately on completion of their maximum tenure and officers with clean track records may be given opportunity to serve in such agencies. (vi) It is requested to provide separate consideration to the cases of physically challenged persons and providing them exemption from Para 5.3 of the policy as per DOPT OM No. 36035/3/2013-Estt.(Res) dated 31.03.2015, wherein it has been specifically mentioned at Para H that “ the practice of considering choice of place of posting in case of persons with disabilities may be continued. MINUTES OF THE MEETING OF CO-ORDINATING COMMITTEE OF REVENUE DEPARTMENTS HELD AT C R BUILDING, NEW DELHI ON 28^TH MARCH, 2016

The Meeting of the Co-ordinating Committee of the Associations in the Departments of Revenue was held, after a long time, on 28^th March, 2016 at the C. R. Building, New Delhi. The leaders of all recognised organisations in the Departments of Revenue participated in the meeting. Com. Raj Singh Meel, Vice-president of ITGOA, presided over the meeting.

The demand for upgradation of Pay of some cadres of the Revenue Deptt. at par with IB & CBI Deptt. was raised and discussed by the comrades.  Representatives of all Federations/Associations raised the 7^th CPC related demands as well as Deptt. specific common demands. All the leaders participated in the discussions.

After detailed discussions, the following demands were finalised and decided to send memorandum to the Finance Minister, Revenue Secretary and the Chairman of the both organisations, i.e. CBDT & CBEC. If there is no settlement or negotiations, the meeting decided to organise various agitational programmes in the month of May, 2016 which may culminate in Strike action. The meeting also decided to organise campaign programme to mobilise our members in favour of demands in the month of April, 2016. It is further decided to revive state level CoCs and hold meetings of state CoCs immediately.

Charter of Demands:

A.     Settle the following pay anomalies between the Cadres of Revenue Department with the cadres of IB/ CBI/other Departments.

(i)                 Havildar/Sepoy of CBEC – from GP of Rs. 1800 to Rs.2000.

(ii)               Tax Assistant of CBDT & CBEC – from GP of Rs.2400 to Rs.2800.

(iii)             Admn.Officer/Pvt.Secretary /Inspector/Preventive Officer of CBDT/CBEC – from GP of

     Rs. 4600 to Rs. 4800.

(iv)              Income Tax Officer/Superintendent from GP 4800 in PB-2 to GP 5400 in PB-3.

B.      An identical Cadre structure of the administrative wing and a Pay structure both in CBDT & CBEC which will also place us on an identical structure of Hdqrs. organization i.e. Secretariat Offices.

C.       To finalise the Recruitment Rules as per suggestions of Recognised Federations/Associations immediately.

With due regards, your kind attention is invited towards Estt. order No. 116/2015 dated 01.10.2015 issued by Central Excise, Delhi on the captioned matter.

2. In the aforesaid order of Central Excise, Delhi, a number of our member Inspectors have got their ICT to Delhi owing to their specific reasons. The last date for joining to Delhi on ICT is 2nd November, which is causing panic among our members to get relieved from Vadodara Zone at the earliest. It is also learnt that dossiers of newly appointed Inspectors have also been received in our zone and their physical and medical examinations are under process.

3. In view of the above, our association and our members would be highly obliged to the gracious approach of your honour to kindly relieve the Inspectors of Vadodara Zone, Surat cluster consisting of Surat and Bharuch Stations, so as to enable them to join Central Excise, Delhi on 2nd November, 2015.

Dated 11.09.2015, we would submit the following issues relating to the welfare measures of our member officers for your kind consideration during the JCM : 1.      Offices and infrastructure of Vadodara Audit-II may kindly be shifted to new accommodation at the earliest, so that our officers may get amicable atmosphere for work. During shifting, proper allocation of space may be made as per DGHRD guidelines and entitlement. If any cut is proposed in space or facilities, the same may be cut proportionately to all the cadres. 2.      Quarterly Cash Reward to the officers for spot recovery of audit based paras may kindly be continued at existed earlier. Commendation Certificates on monthly basis may also be given for extraordinary performance to the best audit teams to boost the morale of the officers. 3.      Ministerial works may not be assigned to the Executive Officers (Inspectors) as far as possible. In case of exigency, Inspectors may be allotted the works and designation of A.O./ACAO. Assigning works of TA/STA to the Inspectors is below dignity/designation, which may be discontinued. 4.      Laptops may be provided to the audit groups. 5.      Newly appointed officers may be assigned regular postings only after completion of induction and in-house training. 6.      Basic amenities may kindly be provided in the bathrooms and proper upkeep and maintenance of the same may kindly be ensured. 7.      Plastic Identity Cards may kindly be introduced. 8.      Computer and printers as a basic infrastructure may kindly be allocated to each and every Inspector. Letter regarding postings to Customs

Subject : Maintenance of Status Quo in the Case of “Not Posting the Fresh Direct Recruited Inspectors in Gujarat Customs Zone” – Reg.

            Your honour’s kind attention is invited towards F.No. A-12034/SSC/03/2013-AD-III(B)(VO-III) dated 01.09.2015 issued by the Hon’ble Under Secretary of Govt. of India regarding Allocation of Inspectors (Central Excise) to Vadodara Zone.

2.         In this regard, it is submitted that as the veryper prevalent practice direct recruit Inspectors are not initially posted in Customs formations. The main reasons behind such practice are as under :

(i) The Direct allocation of Central Excise Inspectors to Customs is contrary to the SSC Selection process.

(ii) For postings to Customs, a Policy has already been devised giving due consideration to the seniormost and juniormost officers.

(iii) Sufficient number of Inspectors, willing to work in Customs is already available in Vadodara Zone.

(iv) Direct postings to Customs formations leaves the parent Commissionerate of the officers undecided.

(v) Such direct postings to Customs results in frequent and repeated postings to Customs of some officers and many officers are denied an opportunity to work in Customs formations.

3.         In view of the above, it is requested that direct recruit Inspectors may kindly be initially posted in Central Excise formations only and the Customs formations may be filled in from the available pool of Inspectors as per Transfer Policy for Customs.

HAPPY NEW YEAR 2016

Dear Comrades,
Year 2015 has been a mixed year for us. We set many milestones and came way ahead of our lost image as an Association. Though it is always tough to satisfy all the members and to fulfill all the whims and wishes, we tried for the best.
We could lead a successful march towards providing better amenities and transparent policies. Customs Transfer Policy was fully implemented by CC office after our hard toned representations and our deserving members got their due. Seniority list was fixed as per N.R. Parmar case, owing to the fights and results brought out through CAT by our members. AGT was done in a manner satisfying all the members since our each and every representations owing to non-implementation of transfer policy was accepted. Transfer Policy was devised in a manner, we had demanded.
Though in the early half, ICT issue was positively considered by the authorities by relieving a good number of our members during October, but due to staff crunch, we could not pursue this issue for the remaining members. We raised this issue though both in writing and verbally but we were not having substance in our demand, when our Commissionerates were working with only around 50% strength.
Our Association funds remained intact. We maintained a balance of more than Rs. 1 Lakhs, even when no deduction of subscriptions were made in 2014 and 2015. Not a single penny was spent from Association fund and our office bearers were benevolent enough to spend wherever required out of their own pockets.
Hope we serve better in 2016. But we also wish a more stable and more substantiated, moral and physical support from you. Wish you a very happy and prosperous New Year 2016.
